TERMS AND CONDITIONS OF SALE

Yarn & Crochet, Auto-entrepreneur, SIRET (to come) , TVA non applicable, article 293B du CGI, hereinafter referred to as “the Company”, offers physical and digital products for sale on the website https://www.yarn-and-crochet.com, hereinafter referred to as “the Site”.

These general terms and conditions of sale (GTCS) govern all transactions between the Company and any individual or legal entity, hereinafter referred to as “the Customer”, wishing to make a purchase via the Site.

Article 1 – Purpose

These general terms and conditions of sale define the contractual relationship between the Company and the Client, as well as the conditions applicable to any purchase of physical or digital products made through the Site.

Article 2 – Products

The products offered are described and presented as accurately as possible on the Site, including photographs and descriptions. Digital products include downloadable files, while physical products may include crocheted creations, accessories, or other handmade items. Images and descriptions may contain minor variations, which the Client accepts when placing an order.

Article 3 – Prices

Prices are quoted in euros (€), VAT not applicable under Article 293B of the CGI, excluding shipping fees. The Company reserves the right to change prices at any time. The price applied will be the one in effect at the time of order confirmation.

Article 4 – Orders

Orders are placed directly on the Site. Any confirmed order implies acceptance without reservation of these GTC. An order summary will be sent to the Client via email upon confirmation.

Article 5 – Payment

Payment is required upon order placement. Payments can be made by credit card through a secure payment system (Stripe). Banking information is not stored by the Company and is processed securely.

Article 6 – Delivery

Physical Products: Physical products are shipped to the delivery address provided by the Client at the time of order. The Company declines any responsibility for errors in the delivery address entered by the Client. Shipping costs, calculated according to the destination and weight of the package, are indicated when the order is confirmed.

• In-stock products: The Company undertakes to ship “in-stock” products within a maximum of three weeks from order confirmation and payment.
• Custom products: For “custom” products, the Company undertakes to make and ship these within 90 days of order confirmation and payment.
While the Company strives to meet these deadlines, it cannot be held responsible for delivery delays due to exceptional circumstances or third parties, including postal services or carriers.

Digital Products: Downloadable products (patterns, guides, PDF files) are accessible immediately upon order confirmation and payment. A download link is sent by email and may also be accessible from the Client’s account, if applicable.

Article 7 – Right of Withdrawal

In accordance with legal provisions, the Client has a 14-day withdrawal period for physical products, starting from their receipt. The product must be returned in its original condition. Return shipping costs are the responsibility of the Client.

Exceptions to the Right of Withdrawal: The right of withdrawal does not apply to digital products once the download link has been activated by the Client.

Article 8 – Availability and Cancellation

Physical products are offered subject to availability. In case of unavailability, the Client will be informed by email and will have the option to cancel their order or wait for the product to be restocked.

Article 9 – Guarantee

The Company guarantees the conformity of products with the descriptions and photographs presented on the Site. However, slight color variations may occur due to the display settings specific to the Client’s screen, which the Client acknowledges and accepts.

In the event of a proven non-conformity or defect, the Client has 30 days from receipt of the order to request, at their option, an exchange or a refund. To exercise this right, the Client must contact the Company via the contact email, providing a description of the defect and proof of purchase.

Return shipping costs are covered by the Company in the case of non-conformity or defect.

Article 10 – Personal Data

The Company is committed to respecting the confidentiality of the Client’s personal data in accordance with the GDPR and the French “Informatique et Libertés” law. The information collected is used solely for order processing and will never be disclosed to third parties.

Article 11 – Intellectual Property

All elements of the Site, including texts, images, digital files, and products, are the exclusive property of the Company. Any reproduction, exploitation, or redistribution of these elements is prohibited without the express permission of the Company.

Article 12 – Liability

The Company declines any liability for damages resulting from misuse of the products sold or any damages resulting from the use of the Site. In the event of proven liability on the part of the Company, the amount of damages shall be limited to the amount of the Client’s order.

Article 13 – Applicable Law and Jurisdiction

These GTC are governed by French law. In the event of a dispute, and after an attempt to find an amicable solution, jurisdiction is assigned to the French courts.
